1. About these Terms

Welcome to YourPropertyValuation.com.au (the "website"), owned and operated by The Property Accountant Pty Ltd (ABN 17 664 478 595) ("we", "us", "our" or the "Company").

By accessing or using the website you agree to be bound by these Terms and Conditions ("Terms"), which form a binding agreement between you and the Company. If you do not agree to these Terms, please do not use the website.

Your use of the website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Our service

The website is a referral platform that connects Australian property owners with registered valuers for the purpose of obtaining a certified property valuation.

When you submit a request through the website, we will:

  • source quotes on your behalf from valuers on our panel (typically one desktop valuation and two in-person valuations);
  • present those quotes to you side by side; and
  • facilitate your engagement with the valuer of your choice.

The valuer you choose will prepare and issue the certified valuation report directly to you.

3. Engagement of Valuer

Although we collect payment on behalf of the Valuer, we do not prepare the Valuations ourselves. We are not a party to your engagement of your chosen valuer.

Valuers on our panel are independent, appropriately registered professionals. They are not our employees, agents or partners. Any dispute about a valuation report is a matter between you and the valuer who prepared it, not us.

The Valuer chosen by you is solely responsible for the accuracy, methodology and professional quality of each Valuation report. We do not review, endorse or guarantee the accuracy, methodology, timeliness or suitability of any valuation report. We make no representation or warranty regarding the content of any Valuation prepared by your chosen valuer.

4. Referral fees

We may receive a referral fee from your chosen Valuer upon engagement of that valuer through the website. This fee is paid to us by the valuer; it is not added to, and does not affect, the fee quoted to you. All valuers on our panel are presented to you on an equal basis, and the choice of valuer is entirely yours.

5. No advice

All information on this website is provided for general informational purposes only. It is not personal tax, legal, financial or valuation advice and does not account for your individual circumstances. You should obtain advice from a registered tax agent, accountant or legal professional (including, if you choose, through The Property Accountant) before acting on any information provided.

6. Prohibited conduct

You must not use the website to:

  • engage in unlawful, fraudulent or misleading conduct;
  • submit false or misleading information in a quote request;
  • use bots, scrapers or other automated means to access, extract or index website content;
  • interfere with the proper functioning of the website or its infrastructure;
  • impersonate another person, or misrepresent your affiliation with any person or entity; or
  • transmit content that is unlawful, defamatory, offensive, or that infringes another person's rights.

We may suspend or refuse access to the website, without notice, if we reasonably believe you have breached these Terms.

7. Intellectual property

All content on the website (including text, graphics, design and any calculator tools) is owned by the Company or its licensors and is protected by Australian copyright law. You may view and download content for your own personal, non-commercial use only. You must not reproduce, republish, or create derivative works from the website's content without our prior written consent.

8. Third party links

The website contains links to third-party websites, including thepropertyaccountant.com.au and the websites of valuers on our panel. We do not control, and are not responsible for, the content, accuracy or privacy practices of any linked third-party website.

9. Use of Artificial Intelligence

You acknowledge and consent to the Company using artificial intelligence tools and automated systems to analyse, process and summarise any Valuation, reports, documents, data or other information you provide through the website or otherwise make available to the Company. The Company will use such tools for business purposes only, including to assist with assessment, reporting, service delivery and improving its services. We will take reasonable steps to ensure that any use of artificial intelligence is consistent with our Privacy Policy.

10. Disclaimer of warranties

To the maximum extent permitted by law, the website is provided "as is". We do not warrant that the website will be secure, uninterrupted or error-free, or that any information on it (including CGT commentary or calculator results) is complete, accurate or current. Calculator results are estimates only, based on figures you input, and are not a substitute for professional advice.

11. Limitation of liability

To the maximum extent permitted by law, the Company excludes all liability for any loss, cost, expense, claim or damage arising directly or indirectly from your use of the website, any valuation report obtained through a valuer on our panel, or your reliance on any information provided on the website. Nothing in these Terms excludes, restricts or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.

To the maximum extent permitted by law, we limit our liability for breach of any non-excludable condition or warranty/guarantee implied by virtue of any legislation to the supply of the services again or the payment of the cost of having the services supplied again (the choice of which is at our sole discretion).

To the maximum extent permitted by law, the liability of the Company to you arising out of or in connection with the website, whether in contract, tort (including negligence), statute or otherwise, is limited to an amount equal to the fees paid or payable by you for the Valuation report.

12. Indemnity

You indemnify the Company and its officers, employees and agents against any loss, liability or cost arising from your breach of these Terms or your misuse of the website.

13. Release

You agree that your use of the website is at your own discretion and risk. You agree to release the Company and its officers, employees, agents, consultants, licensors, partners and affiliates from any claim, demand or cause of action that you may have against any of them arising from these Terms of Use or the use of the website by you or any other person. The Company may plead this release as a bar and complete defence to any claims or proceedings.

14. No waiver

Waiver of any power or right under these Terms of Use must be in writing signed by the party entitled to the benefit of that power or right and is effective only to the extent set out in that written waiver. Any failure by the Company to act with respect to a breach by you or others does not waive the Company's right to act with respect to that breach or any subsequent or similar breaches.

15. Changes to these Terms

We may amend these Terms at any time. Changes take effect once posted to the website, and your continued use of the website after that point means you accept the amended Terms.

16. General

  • Headings are for reference only and do not limit the scope of any provision.
  • If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in force.
  • Our failure to act on a breach does not waive our right to act on that breach or any later breach.
  • You may not assign your rights under these Terms without our prior written consent. We may assign our rights at any time without notice.

17. Governing law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
